The discussion about entering into a premarital agreement while preparing for your marriage is an intensely personal one.  On the one hand, it goes against all romantic notions accompanying your wedding day.  On the other hand, it is often a wise and practical action for many couples to take, not just the very wealthy. 

Also known as pre-nuptial agreements, these written contracts specify each spouse’s rights and responsibilities in terms of separate property brought into the marriage, marital community property, and debts incurred by either party before or during the marriage.  A pre-nuptial agreement pre-determines how these assets and debts will be divided and distributed should the marriage end in divorce.  Additional provisions may involve financial issues such as inheritances for children from previous relationships, stock portfolios, business ventures, pensions, retirement accounts, alimony, and other related matters.

Annulments

The effects of a divorce can be long lasting and far-reaching. This is generally not the case with an annulment. An annulment does not include dividing up property and paying alimony because the marriage is treated as having never existed. From a legal perspective, if certain conditions can be proved in a court, then annulment becomes simply a procedure for declaring a marriage null and void. Child Support

Child support is based on the policy that parents are obligated to pay for the support of children, even when the children are not living with both biological parents. One parent will typically be awarded legal custody, with visitation rights awarded to the non-custodial parent, who remains obligated to pay a proportion of the costs involved in raising the children. Establishing Paternity
