The reasons for such drastic actions are different: sometimes a Ukrainian-born mother cannot adapt to her new life abroad and returns to the safety of her native Ukraine, taking along her child without the father&#8217;s consent. Or a divorce has gone terribly wrong, and the mother takes the child back to Ukraine despite a court order that allows the father visitation rights.<\/p><p class=\"p1\">In all such cases, the result is the same: one of the parents (usually the father) desperately tries to return the child under the rules of The Hague Convention, without any guarantees of success.<span class=\"Apple-converted-space\">\u00a0 <\/span>Below we review the key issues involved in returning the children to their parents.<\/p><h3 class=\"p1\"><span style=\"font-family: Lora, Helvetica, sans-serif; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal;\">1. <\/span><span style=\"color: #332729; font-family: Lora, Helvetica, sans-serif; font-size: 30px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 500;\">The Hague Convention<\/span><\/h3><p class=\"p3\">The Hague Convention (the \u201cConvention\u201d) has two main purposes: to return children abducted by one of the parents and taken abroad without consent of the other parent, and to enforce parental rights to have unimpeded access to their children.<\/p><p class=\"p3\">Under the Convention, the actions of a father or a mother are considered an international abduction if the following conditions are met:<\/p><ul class=\"ul1\"><li class=\"li4\"><span class=\"s3\">The child is under the age of 16;<\/span><\/li><li class=\"li4\"><span class=\"s3\">The child was illegally removed to a foreign country by one of the parents in violation of the other parent\u2019s custodial rights and access to the child;<\/span><\/li><li class=\"li4\"><span class=\"s3\">The child had a permanent residence in a member country that signed the Convention \u201cMember Country\u201d).<\/span><\/li><\/ul><p class=\"p3\">Each Convention Member Country has a so-called \u201cCentral Authority\u201d to ensure the return of the children, and they all adhere to a detailed procedure especially designed to return the abducted child to the parent\/applicant.<span class=\"Apple-converted-space\">\u00a0 <\/span>In Ukraine, the designated Central Authority is the Ministry of Justice (\u201cMinistry of Justice\u201d), which is responsible and empowered to take all steps necessary to return the child to the parent.<\/p><h3 class=\"p3\">2. What to do if your child has been abducted<\/h3><p class=\"p3\">If the child was abducted abroad and transported to Ukraine, the aggrieved parent should immediately file an application with their country&#8217;s Central Authority in accordance with the Convention.<span class=\"Apple-converted-space\">\u00a0 <\/span>This will initiate the legal process, involving the Ministry of Justice, to return the child.<\/p><p class=\"p3\">First, the parent will submit the following documents in English, with a Ukrainian translation:<\/p><ul class=\"ul1\"><li class=\"li5\"><span class=\"s3\">An application form is filled out in English language, accompanied by a certified translation into Ukrainian, about the applicant, the child and the offending parent, reason for request to return the child, etc.<\/span><\/li><li class=\"li5\"><span class=\"s3\">Originals or certified copies of the child&#8217;s birth certificate, parents&#8217; marriage certificate, and divorce decree, as appropriate.<\/span><\/li><li class=\"li5\"><span class=\"s3\">A certified copy of the custody order in effect when the child was taken to Ukraine or a copy of the state law that establishes legal custody, any agreements regarding custody or access. <\/span><\/li><li class=\"li5\"><span class=\"s3\">Authorization form, allowing the Ministry of Justice to work on the abduction case.<\/span><\/li><li class=\"li4\"><span class=\"s3\">Photos of the child and of the offending parent. <\/span><\/li><\/ul><p class=\"p3\">Next, the Ministry of Justice will review the application for compliance with the Convention requirements, and may reject it in certain cases, including the following:<\/p><p class=\"p6\">\u2022 the Convention does not apply to the parent\/applicant country (not a member), or the abduction occurred before the Convention entered into force between the member states;<\/p><p class=\"p3\">\u2022 the child has reached the age of 16;<\/p><p class=\"p3\">\u2022 the application has no legal basis.<\/p><p class=\"p3\">Once the Ministry of Justice accepts the application, the long and arduous process, which begins with identifying the address where the child is located and ends with the return of the abducted child to the parent\/applicant.\u00a0<\/p><p class=\"p3\">According to the Convention, the Ministry of Justice is responsible for taking all appropriate measures to arrange for the return of the child to the parent\/applicant.<span class=\"Apple-converted-space\">\u00a0 <\/span>This usually involves delegating certain functions to other government agencies, including <span class=\"s1\">the Ministry of Internal Affairs and the State Border Service of Ukraine, who assist in locating the missing child. <\/span><\/p><p class=\"p7\">If such information is unavailable, the Ministry of Justice will request the State Border Service and the Ministry of Internal Affairs to locate the missing child and the abducting parent.<span class=\"Apple-converted-space\">\u00a0 <\/span>The State Border Service will provide the Ministry of Justice with information about the time and place the child crossed the border of Ukraine, and the Ministry of Internal Affairs and its regional departments (the police) will attempt to locate the child and the abducting parent.<\/p><p class=\"p7\">It is in best interests of the applicant\/parent to work with the Ministry of Justice in their efforts to locate the abducted child in two ways by providing possible location(s) of the child and abducting parent, or information about other possible addresses, where the child and the abducting parent may be hiding. Any information regarding possible locations is important, because in most cases, the abducting parent will hide their child at the homes of their parents, relatives or friends, knowing that a legal process is taking place (resulting in return their child to the parent\/applicant). Importantly, services of licensed Ukrainian private investigation agencies are often useful in locating the abducted child.<\/p><p class=\"p7\">Once the child has been located, the parent who abducted the child has the right to refuse to voluntarily return the child.<span class=\"Apple-converted-space\">\u00a0 <\/span>In this event, the Ministry of Justice will transfer the case to a Ukrainian court of civil jurisdiction to render its decision. The final decision whether to the return the child lies exclusively with the Ukrainian courts.<\/p><h3><span class=\"s3\">3. Adjudication in case of dispute<\/span><\/h3><p class=\"p3\">In Ukraine, there are no separate family courts to resolve custody disputes.<span class=\"Apple-converted-space\">\u00a0 <\/span>Instead, family law cases are resolved by the local courts, where the defendant resides.<span class=\"Apple-converted-space\">\u00a0 <\/span>According to the procedural legislation, court-ordered decision to return the child may be challenged by filing an appeal to the higher-standing courts.<span class=\"Apple-converted-space\">\u00a0 <\/span>As anywhere else in the world, the court of appeals may revise the local courts\u2019 decisions, and ultimately the Supreme Court renders the final decision, which could revise the appeal courts\u2019 decisions.<\/p><p class=\"p3\">In all legal proceedings related to children, the courts\u2019 decisions are based on the best interests of the child, and in certain situations, the return of the child may be impossible.<span class=\"Apple-converted-space\">\u00a0 <\/span>Thus, depending on the facts of each case, there is no guarantee that the parent\/applicant will prevail in returning the child.<span class=\"Apple-converted-space\">\u00a0 <\/span>For example, a child will not be returned to the parent\/applicant if more than a year has passed since the abduction took place and the child has adjusted to a new society, or if the child objects to return and has reached the age when his\/her opinion must be taken into consideration. <span class=\"Apple-converted-space\">\u00a0 <\/span>The court may also refuse to return the child if there is evidence of a grave risk that the return would expose the child to physical or mental harm or would otherwise place the child in an intolerable situation.\u00a0<\/p><p class=\"p8\">In fact, the Convention contains an extensive list of situations, where the Ukrainian court may refuse to return the child, including the following:<\/p><ul class=\"ul1\"><li class=\"li8\">the person responsible for the child was not exercising the custody rights at the time of removal or retention;<\/li><li class=\"li8\">the person responsible for the child had consented to the removal of such child;<\/li><li class=\"li8\">a grave risk exists that the return would expose the child to physical or mental harm or would otherwise place the child in a harmful situation;<\/li><li class=\"li8\">the child objects to being returned and has reached the age and maturity where his or her views should be taken into account;<\/li><li class=\"li8\">return is not permitted by the fundamental principles of the requested State because of violations of human rights and fundamental freedoms;<\/li><li class=\"li8\">more than a year has passed since the removal and the child has settled in the new environment.<\/li><\/ul><p class=\"p8\">The burden of proving the existence of above-mentioned grounds is on the person who abducted the child.<span class=\"Apple-converted-space\">\u00a0 <\/span>Thus, in order to keep the abducted child, the defendant must submit to the court convincing evidence regarding the parent\/applicant\u2019s acts of domestic violence, either physical or psychological, alcoholism or drug use, psychiatric disorder, etc.<\/p><p class=\"p8\">With regard to the time-frame, Article 157 of the Civil Procedural Code provides a reasonable period of time to consider the case, but not more than two (2) months from the day the proceeding.<span class=\"Apple-converted-space\">\u00a0 <\/span>In rare cases, this can be prolonged by court decision for one (1) more month.<span class=\"Apple-converted-space\">\u00a0 <\/span>Appeals may take up to three (3) months.<span class=\"Apple-converted-space\">\u00a0 <\/span>In practice, the average processing time for Hague cases is between two to four months.<\/p><p class=\"p8\">If the defendant fails to comply with court order to return the child, stiff penalties will be applied. The first violation will result in fines or other penalties (unless the defendant provides legitimate reasons failure to comply with the court order). In case of a second court violation, the state executor imposes double fine, and if the defendant continues to defy the court decision, the state will initiate criminal proceedings.<\/p><h3>4. Enforcement of court order<\/h3><p class=\"p3\">Article 64 of the Law \u201cOn Enforcement Proceedings\u201d instructs the state bailiff (enforcement officer) to effectuate all actions necessary to return the abducted child together with the parent\/applicant, and any representatives of the guardianship and care agencies.<\/p><p class=\"p3\">In practice, the State Execution Service of the Ministry of Justice enforces such court decisions.<span class=\"Apple-converted-space\">\u00a0 <\/span>If needed, the Execution Service involves other relevant agencies, such as local police or children&#8217;s services. Of course, participation of the parent\/applicant is required throughout the enforcement process.<span class=\"Apple-converted-space\">\u00a0 <\/span>For example, the Ukrainian enforcement agencies have to coordinate the date of arrival to Ukraine to personally pick up the child at the time and place specified in the court resolution.<\/p><p class=\"p7\">In conclusion, international child abductions have always been the worst nightmare for any parent, whose child was transported abroad without his or her knowledge or permission. The Hague Convention addresses this terrible reality, and offers a simplified legal process to return the abducted children to their homes.<span class=\"Apple-converted-space\">\u00a0 <\/span>Fortunately, Ukraine is a signatory to the Convention, and in most (not all) cases, justice ultimately prevails with perseverance and assistance of experienced attorneys that specialize in Ukrainian family law.\u00a0<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>International child abductions happen with frightening regularity, and these traumatic events typically involve one of the parents.
